CERTIFIED FLOOD SYSTEMS guarantees the accuracy of all flood zone determinations prepared by said company. CFS guarantees compliance in accordance with the Flood Disaster Protection Act of 1973 and the National Flood Reform Act of 1994. If CERTIFIED FLOOD SYSTEMS errs, and places the insurable real property in a SFHA (Special Flood Hazard Area), CFS will reimburse the borrower for any flood insurance premiums paid as a result of that error. If CFS errs and places the insurable real property outside of the SFHA and an uninsured flood loss occurs, CFS will reimburse the borrower, lender, and/or said representative(s), as applicable at the time of loss. The amount of reimbursement will be based on the uninsured flood loss, and the National Flood Insurance Program (NFIP) flood insurance policy that should have been in effect at the time of loss. CFS will only reimburse the amount allowed, and specified by the NFIP guidelines. CFS CertAlert (life of loan update) are transferable: All rights, updates, and benefits afforded by his product, to include our guarantee, shall transfer to the lending institution which assumes the servicing of the loan for which the flood determination was originated. It is the responsibility of the Clients to notify CFS within 30 days of any change in loan status (loan retirement, changes in loan servicing, loan transfer) and/or any other information necessary to enable CFS, to meet it's obligations relating to the above guarantee. CFS agrees to indemnify Clients and hold them harmless against any and all judgments, decrees, coasts, expenses (including reasonable attorney fees) and/or any other loss which Client might sustain by reason of the service performed.
